Sorry for the delayed reply as I was caught up with many projects at the end of last year so I have not been checking the forum until now.
Is your issue resolved now?
Anyway not sure if you are aware but it is Magento's default behavior to use HTTP instead of HTTPS if there are no products in the Shopping Cart.
