Cart Promo Rule

How can i set up a cart promo rule : if a customer buy 3 items from products without speacial price, then he/she get a discount 15% only for items in cart which haven't special price ?

special_price is a product attribute, you can make it usable in Promo Rules conditions and then EXCLUDE products with such attributes from count in conditions and actions of your cart promo rule.
