My error is with patching file app/code/core/Mage/Adminhtml/Helper/Sales.php. Below is the error I am getting

The previous version was installed by my developer and he said he never change the core file manually which I think is a lie because I checked the core file and noticed $links = array(); was added :

I have delete $links = array(); and remove # infront of the (#$links = []
but still given the same error.

The following is my details and result. I use https://www.magereport.com to get my results and outputted the details into a patch.php file.
I first setup a folder 'backup' which mirrors the public_html, I test there first, however with this one I tested in both.
There is no other patch versions needed below this version.
Cant understand this issue, please help?!
